1.1.A.30 Active participation in a program of support (DSP)
Definition
This definition applies to people who make a new claim or are taken to have made a new claim for DSP on or after 3 September 2011.
To satisfy the CITW (1.1.C.330) criteria for DSP, new claimants who do not have a severe impairment (1.1.S.127) must demonstrate that they have actively participated in a program of support (POS) (1.1.P.440).
A person has actively participated in a POS if the person:
- participated in the program for at least 18 months, or
- completed a program that was less than 18 months duration, or
- participated in a program that was terminated before the date of claim because the person was unable, solely because of his or her impairment, to improve their capacity to find, gain or remain in employment through continued participation in the program, or
- is participating in the program at the date of claim but is prevented, solely because of his or her impairment, from improving their capacity to find, gain or remain in employment through continued participation in the program,
and the person
- complied with the requirements of the program, and
- participated in the program during the 36 months ending immediately before the relevant date of claim,
and
- the person provides the (delegate of the) Secretary with material which demonstrates the person's participation.
