6.7.1.110 Notice of Debts

Summary

In accordance with section 1229 the Secretary must give the person a notice in respect of a debt to the Commonwealth.

 

The notice must specify:

  • the date it was issued,
  • the reason for debt,
  • the period of debt,
  • the debt amount,
  • the day the amount is due and payable i.e. 28 days after the date of the notice,
  • re-payment options, and
  • contact details.

 

In addition the Secretary may give a further notice where the person has failed to:

  • enter into an arrangement to re-pay the debt, or
  • make a payment in accordance with the re-payment arrangement.

 

This further notice specifies the same details as above but also details concerning penalty interest and how it is calculated.

 

Details of penalty interest and how it is calculated can be included in the original debt notice.
